Certified process servers do not execute enforceable writs because they have no statutory authority to do. Only a Deputy Sheriff may execute enforceable writs. No Process Server in the State of Florida may serve a enforceable writ. Some examples of enforceable writs are: Writs of Possession Writs of Attachment Writs of Replevin Writs of Execution Certified process servers 20 Day Summons A 20 days Summons is issued upon the filing of a law suit. It is served on the individual named who is given 20 days exclusive of the day of service to answer in writing to the Court and to the Attorney or Plaintiff. It may be substituted. GO BACK 5 Day Summons A 5 day Summons is issued for a tenant eviction law suit. It is served on the individual named who is given five working days exclusive of the day of service, holidays and weekends to answer in writing to the Court and to the Attorney or Plaintiff (in the case of unpaid rent, also to place the unpaid rent money in the Registry of the Court pending the hearing). As a general rule when the law is counting days, anything less then seven days excludes holidays and weekend days. The 5 day Summons may be substituted or it may be posted after two attempts at personal service at least six hours apart. GO BACK Witness Subpoena A subpoena is a writ compelling a witness to appear and testify in a particular case. It should be issued by the Court and state the location, date and time the witness must appear. GO BACK Distress Writ A Distress Writ is served in actions where money is due a landlord. It may be in one of the following two forms: 1. A service to a tenant which orders the tenant not to dispose of any of the contents of the leased premises pending an order to sell those contents to cover the amount of money owed to the landlord by the tenant. 2. *An order to the Sheriff to seize the contents of a leased premises and hold those contents pending order of the court to sell them. *A Distress Writ of the second type can only be served and executed by the Sheriff. This is called a enforceable writ. Process Servers cannot serve enforceable writs. Note: Distress Writs are for commercial property only; they have been ruled unconstitutional on residential property. GO BACK Subpoena Duces Tecum A subpoena duces tecum is like a witness subpoena as that it commands the appearance of the witness at a particular location, date and time but further that the witness must bring and produce such documents or information as listed on the subpoena duces tecum. GO BACK Criminal Subpoenas These subpoenas, like Civil Subpoenas, command a witness to appear at a particular location, date and time and are served in the same manner. A criminal witness subpoena, after three unsuccessful attempts to serve the subpoena at the witness’s residence on different dates and times of day, may be posted on the witness’s residence. The subpoena must be posted at least 5 days prior to the date of the witness's required appearance.
